we are looking to change our helmet decal and the logo we use. i see that some teams use logos from college and pro teams. how do you get around logo infringement and not get sued? i know of a couple high schools and arena teams have been told to stop using a universities logo. is changing the 2 colors used in the original enough?

We contacted the university that we took ours from and we pay a dollar every 2 years to use one of their copyrighted logos.

Many may even be public domain, especially if you change the colours.

we will be changing the colors. i've heard that a 10% difference makes it eligible for use, but wasn't sure if color fell into that criteria

If you change the logo just a little you will be ok. There is a HS in Minnesota that used the same Cowboy as Wyoming and the school asked for them to pay a fee every year. They took the logo and changed the hand that was hanging onto the saddle and did something different with the horse and cowboy hat.

Why not come up with your own version of the logo you want? Whoever you buy your team gear from probably has a design department. Show some creativity and make it your own. I met a company at a coaches clinic that specializes in this. I told them what I wanted, they came up with some great ideas and I had them redo out school logo just for football. The nice thing is I own the logo, not the school so only football will be able to use it. Another way for us to brand the program.

Having a company do it for you isn't the same as you said "show some creativity and make your own". i don't disagree with what your saying, but you had a company design you a logo and then used the school logo to "make it your own". that's essentially what we are doing while looking for a new B to use. what do you do when the school says that only school approved logos may be used, and yours isn't on their approval list?

I would find out what is on the approved list and then find out what changes or tweaks to the logo would still be approved. IF there is not "wiggle room" for the changes, then you contact the team that you are using the logo and then report to the "approving authorities" how much you would have to pay to keep using it. most will approve the changes when paying out lots of money is involved.

I never understood how you can quantify a 10% logo change. At my previous school, a company we used told us that our Eagle logo was too similar to the Philadelphia Eagles logo and it needed to be at least 10% different?

I have emailed the department, at the university, that handles the logo and use of it and have asked them for permission to use the logo with our school color. the people at the decal company said that the 10% difference is fallacy and that there is no real way to establish a 10% difference. they are going to go ahead and work up a 'new' logo for me.

Well, I am not a graphic designer by trade although I can do pretty good with stick figures. What I mean is come up with an idea of a logo change or design you would like and then get with the company of choice to do the actual artwork. I had an idea of what I would like to have made and approached one of the kids I know who is terrific at drawing. I had him make a sketch of what I wanted, then I forwarded that to the graphic company and went back and forth a few times and we came up with the finished product. As far as what do I do about what the school says, I truly could care less what they say, but that is just me. The generic stuff that the school comes up with is terrible. We are not replacing our jersey logos or helmets or anything else, but instead we are going to use this for our weight room reward shirts and also apperal that we sell to the general public. Maybe even use it for the spirit gear stuff for the players.

Be very careful when "borrowing" another school's logo, even if there are minor changes. A school here got sued for a ton of money after a college saw a picture of its logo, with the colors changed, at midfield of their brand new turf stadium.

We are the Chargers...like a war horse. We use the Boise State Bronco logo because its sharp. However, we get our decals from Pro Tuff Decals and they make slight modifications to it ( (not including the color changes) because they won't reproduce the exact logo for copyright reasons. So that makes it easier for us. We get the logo we want or as close to it as we can and we're still legal. I don't know if they apply the "10%" rule mentioned by a few coaches in this thread. But they change enough to allow us to use it which is all I'm concerned with.
